How we handle and protect your personal information, in line with the Protection of Personal Information Act (POPIA).
This Privacy Policy explains how CleanCredit, a division of The Debt Company ([Company registration number — to be added]) (“CleanCredit”, “we”, “us”), collects, uses, shares and protects your personal information when you contact us or use our credit-record assistance services. We are the responsible party for your personal information under the Protection of Personal Information Act, 2013 (POPIA).
To assist with your credit record we may collect: your name and contact details (your email address); your identity number and address; information about your accounts, debts, judgments, credit bureau listings and financial circumstances; and documents you send us, such as proof of payment, paid-up letters, statements and correspondence.
We collect information directly from you when you contact us by email or through our website, and, where you authorise us to act on your behalf, from creditors, attorneys and the registered credit bureaus.
We process your personal information to: assess your credit record and advise you; prepare and lodge disputes, updates and applications; correspond with creditors, bureaus and attorneys on your behalf; provide you with feedback and manage your case; comply with our legal obligations; and, where relevant, invoice you for services.
We process your information on the bases permitted by POPIA, including your consent, the performance of a contract or mandate with you, compliance with a legal obligation, and our legitimate interests in providing the service you requested. You may withdraw consent at any time, although this may prevent us from assisting you.
We share your information only as needed to provide the service, for example with the registered credit bureaus (TransUnion, Experian and XDS), your creditors, and qualified attorneys where a legal step is required. We may use trusted service providers (such as secure IT and communication providers) who process information on our behalf under confidentiality obligations. We do not sell your personal information, and we do not share it for third-party marketing.
We keep your personal information only for as long as necessary to provide the service, to comply with legal and regulatory obligations, and to resolve disputes, after which it is securely deleted or de-identified.
We apply reasonable technical and organisational measures to safeguard your information against loss, unauthorised access and misuse. While no method of transmission or storage is completely secure, we take the security of your information seriously.
You have the right to: request access to the personal information we hold about you; ask us to correct or delete information that is inaccurate, outdated or excessive; object to processing in certain circumstances; and withdraw consent.
