A South African helped by CleanCredit with rehabilitation after sequestration

If your estate was sequestrated, you do not have to wait the full ten years for automatic rehabilitation. In most cases you can apply to the High Court from four years after sequestration — sometimes sooner — to be rehabilitated, ending your insolvency and the restrictions that come with it.

Rehabilitation restores you to the marketplace: you can obtain credit again, own assets outright and hold a directorship. It also updates your credit record — the sequestration listing is removed and your status reflects “rehabilitated”. We manage the process together with qualified attorneys.

What rehabilitation after sequestration includes

The service covers

  • An assessment of whether you qualify and when
  • Preparation of the affidavit and supporting documents
  • The required Government Gazette notice and notices to the Master and trustee
  • Lodging the High Court application through qualified attorneys
  • Submitting the rehabilitation order to the credit bureaus afterwards

How it works

  1. Free assessment of your sequestration and eligibility.
  2. We gather the trustee documents and prepare your application.
  3. The application is lodged in the High Court with jurisdiction where you live.
  4. Once granted, we ensure your record is updated across the bureaus.

Who it’s for

This is for anyone who has been sequestrated and wants to close that chapter — typically from four years after sequestration once the trustee’s account is confirmed by the Master, or earlier in specific circumstances such as full payment of claims or an accepted composition.
